Privacy Policy

This policy covers the website vinquando.com (Part A) and the Vinquando iPhone app (Part B). In short: the website sets no cookies and measures nothing. The app has no account, no tracking and no server of its own — what you do in it stays on your iPhone.

This is a translation for your convenience. The German version, Datenschutzerklärung, is legally binding.

Part A — Website

2. Hosting and server log files

The website is served by Vercel Inc., 440 N Barranca Avenue #4133, Covina, CA 91723, USA. With every request, the server processes information that your browser sends for technical reasons:

The purpose is to deliver the website and to keep it running and secure, for example by detecting and fending off attacks. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest is a secure, working website. The log data is kept only as long as needed for operation and security. We do not combine it with other data, and we do not analyse it to identify visitors. Providing this information is not required by law or contract; without it, however, the website cannot be delivered.

Vercel processes this data on our behalf (Art. 28 GDPR) under its data processing agreement. Where Vercel processes data for its own purposes, for instance to protect its platform, Vercel is itself responsible for that; see Vercel’s privacy policy.

Vercel Inc. is based in the USA and is certified under the EU-U.S. Data Privacy Framework. For certified companies, the European Commission has found an adequate level of data protection (adequacy decision of 10 July 2023, Art. 45 GDPR).

3. No cookies, no analytics, no third-party content

The website sets no cookies, stores nothing in your browser’s web storage (such as localStorage) and uses no analytics or tracking tools. Your browser merely keeps the style sheet and images in its cache as usual and remembers that the site may only be opened over an encrypted connection (HSTS); this is technically necessary to display the site. The style sheet and images come only from vinquando.com itself; text is set in your device’s system fonts. No content is loaded from third parties. The language switch uses ordinary links and is not stored.

Links to other websites, such as Vercel or the supervisory authority, take you to their pages, where their rules apply.

4. Contact by email

If you write to us, we process your email address, your name if you give it, and the content of your message including attachments, in order to answer your enquiry. The legal basis is Art. 6(1)(b) GDPR where your enquiry concerns the use of the app, and otherwise Art. 6(1)(f) GDPR (our interest in answering enquiries). Messages are held by our email provider, INWX GmbH, Prinzessinnenstr. 30, 10969 Berlin, Germany, which processes them on our behalf (Art. 28 GDPR). We delete them once the enquiry is settled, unless statutory retention periods apply. You are not required by law or contract to provide any data; without your email address, however, we cannot reply.

Part B — The Vinquando app

5. The principle

Vinquando works without an account, has no server of its own and contains no third-party analytics, tracking or advertising software. The app sends us no personal data. What you do in the app is processed and stored on your iPhone; we have no access to it. You do not have to provide any personal details to use the app.

6. Label photos, camera and photos

Vinquando uses the camera only after you have allowed it in iOS. Alternatively, you choose a photo through the iOS photo picker; the app receives only the photo you select and has no access to your photo library.

The text on the label is read on your iPhone using Apple’s text recognition (Vision). The photo is then discarded: it is neither stored nor uploaded. The app matches the recognised text against its built-in wine library on the device.

You can withdraw camera access at any time in the iOS Settings under “Vinquando”.

7. What is stored on your iPhone

So that Vinquando can remember your bottles, the app stores the following in its own storage area on your device:

Vinquando transfers this data nowhere. Storing this on your device is strictly necessary for the functions you expressly choose to use (Section 25(2) no. 2 TDDDG, the German Telecommunications Digital Services Data Protection Act); as the data never leaves your device, we do not receive it. To delete a single bottle, swipe left on it in the list “Your bottles”; deleting the app removes all of the app’s data. If you use iCloud Backup or back up to a computer, this data is included like that of any other app; Apple’s rules or those of your backup apply.

8. Notifications

For the decanting timer and the reminders for each step of the evening plan, Vinquando uses local iOS notifications. They are scheduled and delivered on your iPhone; there is no push server. The app asks for permission only when you first start a timer or turn on reminders. You can withdraw it at any time in the iOS Settings.

Vinquando currently shows no product links. In future, the app may suggest suitable glasses or decanters and link to retailers. Such a link opens the retailer’s website, where the retailer’s privacy rules apply.

If a link is an affiliate link, it may contain a partner identifier so that the retailer or the affiliate network can attribute a purchase and pay us a commission. The retailer or network may use cookies or similar technologies for this and is responsible for them. Such links will be marked as advertising in the app, and the app will not send any data about your bottles. A partner identifier exists only once such links are built in, and we will update this policy before then.

10. App Store and Apple

You download the app from Apple’s App Store. Apple processes data for this under its own responsibility, and Apple’s privacy policy applies. If you have turned on “Share With App Developers” in iOS (Settings › Privacy & Security › Analytics & Improvements), Apple provides us with crash reports and aggregated usage statistics without your name. We receive no information from Apple that identifies you personally.

Part C — Your rights

11. Your rights

You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), notification of recipients about a rectification, erasure or restriction (Art. 19) and data portability (Art. 20), as well as the right to object (Art. 21, see section 12). An email to support@vinquando.com is enough. Data that exists only on your iPhone is not visible to us; you manage and delete it yourself in the app.

12. Right to object under Art. 21 GDPR

Where we process data on the basis of Art. 6(1)(f) GDPR (server log files, answering emails), you have the right to object at any time, on grounds relating to your particular situation.

We will then no longer process the data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims. We do not process data for direct marketing. An informal objection by email to support@vinquando.com is enough.

13. No sale, no profiling

We do not sell data, we do not build profiles, and we make no automated decisions within the meaning of Art. 22 GDPR.

14. Changes

We update this policy when the website or the app changes. The version published here applies.
